These Terms of Use ("Terms") govern your access to and use of the PINQ mobile application, website (pinq.health), and related services (collectively, the "Service") provided by HealthOS Sdn Bhd("PINQ", "we", "us", or "our").
By creating an account or using the Service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement.
PINQ provides a digital maternal health record platform that allows expectant mothers to store, manage and share their pregnancy records with authorised healthcare providers and family members.
The Service is offered in two tiers: the Family App (free for expectant mothers and their families) and the Clinic Portal (subscription-based SaaS for healthcare facilities, governed by a separate agreement).
PINQ is not a medical device and does not provide medical advice. All clinical decisions must be made by qualified healthcare professionals. Alerts and reminders in the app are informational only.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access via our contact form.
You may not create accounts on behalf of other people without their explicit consent, or use automated means to create accounts.
You agree to use PINQ only for lawful purposes. You must not:
Upload false, misleading or fraudulent health information; impersonate a healthcare provider; attempt to gain unauthorised access to other users' records; use the Service to distribute malware or conduct phishing; reverse-engineer, decompile or disassemble any part of the Service; or use the Service in any way that could damage, disable or impair its operation.
The Service is designed to help you organise and share your health records — it is not a substitute for professional medical care. Always consult a qualified healthcare professional for medical advice, diagnosis or treatment.
In a medical emergency, contact emergency services (999 in Malaysia) immediately. Do not rely solely on the app's emergency QR feature in time-critical situations.
All intellectual property in the Service — including software, design, trademarks and content created by PINQ — belongs to HealthOS Sdn Bhd. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.
Your health data belongs to you. You retain full ownership of all personal and health information you upload to the Service.
To the maximum extent permitted by Malaysian law, PINQ shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service, including but not limited to loss of data, medical outcomes, or reliance on information displayed in the app.
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or RM 100, whichever is greater.
You may delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms, with or without notice.
Upon termination, your personal data will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
